Your
Constitutional Rights Always keep in mind that you have
constitutional rights that were put in place to
protect you. If you are questioned by police,
someone acting for them or have been arrested
for a crime, whether felony or misdemeanor, you
may, depending on the circumstances, have and
exercise the following constitutional rights:
You have the right to
remain silent and to consult with a
lawyer prior to making any statement. No
one can force you to make a statement or
testify against yourself during a
proceeding. Note that the police will
often times attempt to entice you to
waive this right and talk to them with
comments such as: "what have you got to
hide?" or "I am sure that we can clear
this up if you just tell us what
happened." In my many years of law
enforcement I have rarely seen a
statement used by police to help the
accused and they are often times taken
out of context in police reports. Like
they told you about drugs in school,
JUST SAY NO!
You have the right to
have your attorney present with you
during your court proceedings.
You have the right to
a speedy, public trial by an impartial
jury of your peers.
You have the right to
hear and question any and all witnesses
who testify against you at trial.
You have the right to appeal a conviction of
guilt after a trial has concluded.
